Technically Kelly is being charged with two counts of disorderly conduct for offensive language, D.C. Code § 22–1321, for hurling insults at MAGA.
Kelly was offered a plea deal—and declined as to not normalize this attack on Americans’ first amendment rights.
“I was pretty much scolding them for their bad decisions, but I believe that’s protected under first amendment rights,” Kelly told our Allen-DuPraw. “I am here fighting a trial, standing for my first amendment rights. My protest style is agitational, it’s loud, it’s vulgar.”

Kelly was on the front lines of Minneapolis ICE protests every day, routinely screaming—and cursing—at ICE and Border Patrol agents. He called them traitors and condemned them for violating the constitution and the rights of both U.S. citizens and undocumented immigrants.
Along with journalism Don Lemon and other protesters, Kelly was arrested for protesting at a St. Paul, Minneapolis church in January.
Outside his D.C. trial, Kelly told us normal protest is no longer going to cut it in Donald Trump’s America.
“The Voting Rights Act being gutted, humans being dragged into concentration camps…I don’t think standing on the side of the road and having a parade at this point is gonna cut it. I think we need more civil disobedience, whether it be from blocking access at detention centers or by raising your voice and calling people out for their support of this f*cking insanity.”
